This Terms of Use Agreement ("Agreement"), along with our Privacy Policy and any other posted policies, constitutes the full agreement between you and Engiwiz LLC concerning your use of the Site. We reserve the right to update or modify this Agreement at any time without prior notice. Continued use of the Site after changes are posted signifies your acceptance of the revised terms.

2. User Accounts and Conduct

a. Account Registration:

You may be required to create an account to access some features of the Site. You agree to provide accurate, complete information and maintain the security of your credentials. You are responsible for all activity associated with your account.

Engiwiz LLC reserves the right to terminate accounts found in violation of these terms.

3. Subscription, Payments, and Refunds

Paid features require a valid subscription. You authorize Engiwiz LLC to charge your payment method on a recurring basis. Subscriptions auto-renew unless canceled in advance.

Refunds are issued at our sole discretion. If a payment fails, access may be suspended or terminated.

4. Intellectual Property

All content, tools, visualizations, and data formatting on the Site ("Site Content") are the intellectual property of Engiwiz LLC and are protected by copyright, trademark, and other laws. You may not copy, redistribute, or repurpose Site Content without our explicit written permission.

5. Public Data Disclaimer

Engiwiz LLC, through BidQuant, utilizes publicly available data from Departments of Transportation (DOTs), including but not limited to the Texas Department of Transportation (TxDOT). We are not affiliated with or endorsed by any DOT or governmental agency.

The original DOT data remains the sole property of the respective agency. Engiwiz LLC may reformat, aggregate, or analyze this data, but we make no warranties regarding its accuracy or completeness.

Use of any DOT data via this Site is at your own risk and subject to applicable public use licenses or disclaimers.

6. Site Changes and Limitations

We do not warrant that the Site or its outputs will be error-free, uninterrupted, or reliable. We reserve the right to make changes to the Site, its features, or its functionality at any time.

7. Termination

We may suspend or terminate your access to the Site at any time, with or without cause or notice, particularly in the event of a violation of these Terms.

8. Disclaimer of Warranties & Limitation of Liability

This Site is provided "as-is" and "as-available" without any warranties of any kind. Engiwiz LLC disclaims all warranties, express or implied, including merchantability or fitness for a particular purpose.

In no event shall Engiwiz LLC be liable for indirect, incidental, or consequential damages arising from the use of the Site or its content.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
